MISDEMEANORS
Many people have the preconceived notion that being charged with a misdemeanor is "not a big deal"--That this type of charge merely requires paying a fine. This couldn't be further from the truth. If you have been charged with a misdemeanor crime and a date has been scheduled for you to appear in court, I urge you obtain professional legal counsel now. Some misdemeanor offenses can carry up to a year jail sentence, if convicted.
MISDEMEANORS
Animal Abuse
Drunk in Public
Environmental Violations (can be felony)
Loitering
Pandering
Property Crimes (can be felony)
Public Nuisance
Shoplifting
Trespassing
Vandalism (can be felony)
AUTOMOBLE OFFENSES
Parking Tickets & Towing and most Moving Violations only require you to pay the required fine for the offense. You may also have the option to attend traffic school near you or traffic school online. You may attend multiple times but only once in any 12 month period. Traffic School is to eliminate 1 point on your driver's license record which, in turn, keeps your auto insurance company from increasing your policy rate.
The items listed below require a court appearance because they are more serious in nature.
Exhibition of Speed, Reckless Driving,
Open Container, Wet Reckless Driving, DUI, DWI,
Driving with a Suspended License,
Driving without a License
POST CONVICTION RELIEF
Writs & Appeals - Expungements & Pardon
After a conviction, you may be able to appeal your matter or obtain other post-conviction relief such as a writ of 'Habeas Corpus'. Angela Berry-Jacoby has extensive experience in all post-conviction relief matters starting with her school internship with the Office of the California Attorney General in the Criminal Appeals Division. Since then, she has been attorney of record in numerous appeals and petitions for Writ of Habeas Corpus and has argued before the California Court of Appeals.
Another form of post-conviction relief Angela can offer you is the process of cleaning up your record. An expungement permits you to lawfully answer that you have not been convicted of a crime with certain specific exceptions. Please consult with an attorney about this before answering such questions.
A more complete restoration of rights can be obtained through a full pardon by the state’s governor. There are statutory restrictions and prerequisites to the pardon process, and Angela Berry-Jacoby knows this process and the law.
